Hays’ Information sheet to the Candidates concerning the purposes and means of handling Personal Data pursuant to art. 13 of the Code concerning the protection of personal data (legislative decree no. 196 dated 3rd June 2003, the “Privacy Code”)
Entitlement to the handling
Hays S.r.l. (hereinafter Hays) with offices in Milan, Corso Italia 13 was authorised by order no. 13/I/0007145/03.04 of the Ministry of Labour and Social Security dated the 1st April 2008 to pursue activities of research and selection of personnel, governed by legislative decree no. 276 dated 10th September 2003 (“Biagi Law”) and by Ministry Decree 23rd December 2003 (hereinafter the Service).
Variety of data handled
Hays handles data relevant to potential candidates for a job position who contact Hays sending their curriculum (hereinafter the Candidates) in order for it to be transmitted to the physical persons, companies or entities which relate with Hays in order to avail themselves of the Service (the Clients). The information contained in the curricula and further information provided to Hays by the Candidates (the Personal Data) constitute personal data pursuant to the Privacy Code. This information sheet concerns the purposes and means of the handling of Personal Data and is supplied by Hays – as autonomous party entitled to handle data – to the Candidates pursuant to art. 13 paragraph 5 letter c of the Privacy Code.
Hays exclusively handles Personal Data strictly related to the correct performance of the Service and cancels all Personal Data provided by the Candidates which are not necessary to this end.
Means of collecting Personal Data
The Candidates communicate their Personal Data to Hays sending their curriculum:
(a) by way of spontaneous application;
(b) as an answer to specific search and personnel selection postings by Hays on newspapers, magazines, on its website or on other specialized websites.
The Personal Data is sent by the Candidates by mail, fax or other electronic means.
Hays subsequently asks the Candidates to fill in the included application for the selection (the Application). The conferment of Personal Data is not mandatory. Failure to confer data and consent (when requested) by the Candidate shall cause Hays’ impossibility to perform the Service.
Consent to the handling of Data
When filing the Request, Candidates must indicate:
(a) if the curriculum and the information supplied by the Candidate are given in order to participate to one sole specific personnel research; or
(b) if the curriculum and the information supplied by the Candidate are given in order to participate also to following personnel selections.
When filling in the Application the candidates can indicate their preference regarding the subjects to which the Personal Data can/cannot be communicated to.
When the Candidates supply their Personal Data in order to participate in the following selections it is necessary for them to grant Hays their consent to their handling. Otherwise the Application and/or the curriculum sent solely destined to participate in a specific selection of personnel is to be intended as acknowledgement of this information sheet and consent to the handling of personal data within the selection to which the candidate intends to participate.
Scopes and means of handling
Hays handles Personal Data of the Candidates as an autonomous party entitled to the handling, in order to perform the Service (according to the requests of the Candidate), and sends the Candidates information on the said Service. The Personal Data are registered, selected, reorganised, elaborated and adapted in order to be chosen and utilised – by electronic or manual means – for the sole purpose of granting the Service.
Circulation and communication of the data
The handling of data for the above indicated purposes is done respecting the confidentiality and security rules provided for by the Privacy Code and by the Biagi law (ref: articles 8, 9 and 10). The Personal Data are handled only by the people in charge appointed by Hays, for purposes strictly connected with the performance of their professional tasks. The Personal Data are communicated to the Clients in order to grant the Service and to the Borsa Continua Nazionale del Lavoro pursuant to the decree of the Labour and Social Politics Ministry dated 13 October 2004. The Personal Data may be communicated for the same scopes to foreign sister companies connected to Hays in EU countries.
Non relevant Susceptible data
Some Personal Data are classified by the Privacy Code and by the Biagi Law (ref: article 10) as Susceptible Data.
In particular data which might reveal:
(a) ethnic or racial origin;
(b) religious, philosophical or other creed, political opinions;
(c) adhesion to political parties, trade unions, religious, philosophical, political or trade union associations or organisations;
(d) state of health;
(e) sexual life.
Hays encourages the Candidates not to supply Susceptible Data. If the curriculum or the Application sent by the Candidate contains Susceptible Data it shall be immediately cancelled, also if a specific authorisation to handling them is granted.
Susceptible Data in particular types of selections
For some specific types of selections the Candidates may have to communicate a number of Susceptible Data to Hays, and this may happen when:
(a) The selection of personnel regards Candidates who are within of the so called “protected categories”;
(b) the Candidate must declare a specific physical capability (e.g. absence of specific sicknesses) in order to participate in the selection.
(c) the Candidate must declare a specific philosophical or political idea (e.g. personnel selection for clients such as political parties, religious organisations or trade unions).
We encourage the Candidates who supply Hays with such Susceptible Data to declare in writing their consent to the handling of the above mentioned data, adding to their curriculum a declaration stating:
“the undersigned acknowledges the information concerning the protection of the Candidates’ personal data given by Hays on the website www.hays.it and consents to the handling of the susceptible data necessary for the performance of the transactions indicated in the information sheet. Readable signature ______________________”.
Failure to declare one’s consent in writing to their handling, Susceptible Data shown in the curriculum and/or the Application sent by the Candidate shall be immediately cancelled.
Keeping of the Data
Personal Data of each Candidate who has granted his/her express consent to the handling for more than one selection shall be kept in the Hays database for two years, in order to be communicated to Hays’ Clients who are interested from time to time to the hiring of Candidates having a profile similar to the one of the Candidate.
Hays may from time to time ask the Candidates to update their data.
Rights of the Candidates
At any time Candidates may exercise towards Hays the rights granted to them by article 7 of the Privacy Code, and in particular they may obtain the confirmation of the existence of their Personal Data among those handled, be made aware of the contents, origin and ways of treatment, check the exactness, request an integration, update, amendment or (in specific cases) cancellation of their data. The above mentioned rights may be exercised by asking a person in charge appointed by Hays for the handling of personal data, at Hays Milan offices, Corso Italia 13, 20122 Milan, or by sending an email to milano@hays.it
